Working Group Reports

• Fred
  • OSV TA
  • Introduce city officials to other cities where there have been successful planning process (Washington, DC and Rochester, NY).
  • Thank people for Bart and Pat tour
  • Fred trying to get perspective on the collaborative from CBOs, he will also be talking to city and county officials.
  • Themes:
    • Role of collaborative: this role still needs definition, more structure and accountability, good vehicle for information exchange.
    • Issues and concerns regarding: relationship between collaborative and Casey
    • Connection to broader community – How to connect to broader San Antonio constituency.
  • Would like to get into more detail at the next meeting.

• Required to pay for private property, just compensation
• Lots of opportunity to comment before they get to eminent domain

Notices and eminent domain

Notice of decision and appraisal

• How property is appraised to give just compensation
• Will probably hire a consulting firm to do appraising
• May not want to see propertywill determine value based on comparable sales
• It is better for them to walk through to show them feature of property that add value
• District will make an offer
• Given time frame to accept or reject offer is 2-3 weeks
• District is required to give just compensation
• Unique process for business ownersmust be “good will”
  • There are qualities of a business that make it more valuable.

Notice of intent to displace

• Not required by law, but recommended
• Notice to people who will be displaced
• Notice that they will talk about relocation

Citizen Participation in Displacement Process

• Relocation Committee
• Offer input to district on relocation assistance
• Could work with district earlyget them to send out notice of intent to displace

Notice of Hearing

• After they receive an offer on property
• 15 days to prepare for hearing
• How to contact district will appear at hearing
• Formalityfor district to make public a set of findings
• Opportunities to make views public
• Resolution of Necessity
• Next step to file suit

Order of Posession

• District can take property before resolution of suit
• District can put escrow in court
• Court can grant order of possession
• No less than 90 days to vacate property
• Can petition court for hardship circumstances

Relocation Assistance/ Separate from EO

• School district has to help you find a new home/property
• Required to communicate regularly so people understand process
• Citizen participation is key
• Relocation committee can review relocation plan
• Minimum of 30 days review period for relocation
• Sooner the committee is formed the better
• 60 days after just compensation value, required to:
  • provide written materials on relocation notice
  • needs to be in language that people can understand
  • send someone for personal interview
    • income, size of family, age, location of work, area where you prefer to be relocated, own, rent, needs for social and public service, children require special services, amenities.
• School district needs to understand individual needs
• Conduct a survey of available housing and business locationshave to make info available.

  • Binding commitment from government entity to assist.

Comparable Replacement Housing

• Everyone displaced must be relocated, but can move people to temporary housing. This housing must be similar (size, #of rooms, quality of construction. Housing has to be in financial means

Last Resort Housing

• Can build housing, but unusual funds needs to be available, worth bringing up, but can kill a project.
• City has it’s own requirements
• Financial assistance
  • Have to help people move
    • Transportation, packaging, etc.
    • Can provide money upfront as oppose to reimbursement
    • Special funds for licensing, etc.
• Replacement Housing Payments
  • If not able to find comparable housing, district can give replacement housing
  • Short term subsidy, 42 month stretch.

Discussion

• There is no comparable housing in Oakland.
• Can push hard to get people comparable housing, but this can stall the project
• School district has to provide habitable housing
• Survey start in concentric circles ( Neighborhood, Oakland, Alameda County)
• Third Party Relocation groups
• Financial Assistance for homeowners that want to purchase new homes.
• Relocation committee laws are not clear
• 9-13 groups relocated (argument that district needs housing plan)

Next Steps

• OCO: Need to develop relationship with the City. Make sure the city and school board work together. Dialogue an the City level
• Establish core recommendations to OUSDWill respond to committee if they take leadership. Equal partnership between OUSD and City.
• EBALDC: Take a look at General Plan/ Consolidated Plan see if the city is compliance
• Urban Strategies Council: Look at cities that have been through a similar process (LA, SF)
